BOSTON — Forty years ago, Heisman Trophy winner Doug Flutie rolled to his right and threw a pass that has become one of college football’s most iconic moments. With Boston College trailing defending champion Miami, Flutie threw the Hail Mary and found receiver Gerard Phalen, who made the grab while falling into the end zone behind a pair of defenders for a game-winning 48-yard TD. Flutie and many of his 1984 teammates were honored on the field during BC’s 41-21 victory over North Carolina before the second quarter on Saturday afternoon, the anniversary of the Eagles’ Miracle in Miami. “There’s no way its been 40 years,” Flutie told The Associated Press on the sideline a few minutes before he walked out with some of his former teammates to be recognized after a video of The Play was shown on the scoreboards. MEMPHIS, Tenn. - A Tennessee state senator is speaking out again against Shelby County General Sessions Judge Bill Anderson and Shelby County District Attorney Steve Mulroy. Sen. Brent Taylor (R-Memphis) released courtroom audio of the hearing where Anderson released a man accused of shooting his co-worker at the FedEx World Hub last month on his own recognizance. Taylor’s take on Judge Anderson releasing people accused of serious violent crimes is no secret. Taking to the social media platform X, Taylor said he got his hands on audio of the hearing where Judge Anderson released accused gunman and 18-year-old Tyreese Earnest from jail on his own recognizance. RELATED: Emergency appeals filed by District Attorney in multiple violent offender cases, records show “You have an opportunity to do something with your life. You got to wake up, you put yourself in a tough position, but anything in the world you have to do, whether it be here, where you are or wherever it is, you have a chance to become a real man,” Anderson told Tyreese Earnest, according to the audio recording. According to investigators, Earnest and two others are accused of ambushing a coworker when he got to his vehicle in the FedEx Hub Employee parking lot last month. RELATED: Three men arrested in shooting of fellow FedEx employee, records show “I'm going to give you a chance to get your act together. But I'm going to watch you like a hawk in every court hearing. I'm going to have in the courtroom this week after what you had done, the fact that I know if I see one negative, one negative, he didn't call it anything like you supposed to,” Anderson told Earnest, according to the audio. Investigators identified Earnest as the shooter from surveillance video. A judicial commissioner set bail for Earnest at $200,000. That bail was later erased to nothing after Judge Anderson reviewed the case and decided to release Earnest on his own recognizance. RELATED: Man accused in FedEx parking lot shooting released on his own recognizance In his post, Taylor called out Mulroy for failing to not aggressively argue for a high bond for Earnest. FOX13 reached out to the DA’s office about the authenticity of the recording. A spokesperson confirmed it is real but incomplete. The statement said the recording was delayed and much of the prosecution’s argument is not captured. The DA's statement is below: "While the audio is authentic, it is incomplete, and failing to acknowledge that is highly misleading. Here's what happened: During the bail hearing, the prosecutor argued against the ROR and advocated for maintaining the bond. She specifically cited: the violent nature of the crime, the potential loss of life, the strength of the case, and the risk of flight. Unfortunately, a delay in activating the court recorder — an occasional issue in General Sessions Court, which is not a court of record — resulted in much of the argument not being captured. This context is important to clarify. The prosecutor is a seasoned attorney with over a decade of military prosecutorial experience. It is disappointing that narratives are being formed without consulting our office, as this undermines the work of our more than 100+ prosecutors who do this work every day. Misrepresenting their efforts is a disservice to the community." Anderson also released on their own recognizance, also known as ROR, the other two suspects connected to the shooting: twin brothers Jamarcus and Jamarion Odell. All three were given rules that must be followed or they return to jail with their bail doubled. “I only need one thing and you're going right back. And this time that you have now, it's going away. It's going to be doubled. So it's going to be $400,000 if you don't follow the rules. I don't know what this case is about yet, but I also realize when this case comes up for hearing, it continues to make no sense to me,” Anderson told Tyreese Earnest in audio recording. Below are some of the posts Sen. Taylor made Saturday on the social media platform X: "I have obtained the audio (link in comments) for the hearing where so-called Judge Anderson unacceptably granted a ROR to dangerous criminal Tyreese Earnest. Frankly, this whole bond hearing involving Judge Anderson and DA Mulroy’s office (expletive) me off! It highlights what is so wrong with our justice system in Shelby County. I recommend turning on alerts for my social media posts as I will be posting a series of informative explanations on what went wrong in this hearing. I know this hearing is long, but I also recommend listening to it for yourself to assess whether what the DA’s office is saying occurred actually happened. This grave injustice is made worse by misrepresentations from DA Mulroy, and the public should be outraged by his disingenuousness. In today’s post, I’d like to address the Assistant District Attorney’s failure to aggressively argue for a high bond to protect our community. Despite DA Mulroy stating “the DA’s office opposed lower bond and ROR”, the ADA in this case was as weak as a kitten’s meow. I never heard the Assistant District Attorney ask for a high cash bail and was not nearly forceful enough in fighting for bail. The ADA would have been just as effective sitting in the audience watching the proceeding as a spectator. Please don’t take my word for it, listen for yourself! I do not know what it will take for DA Mulroy to stop hiring defense attorneys, public defenders, and kids right out of law school as prosecutors and instead hire and train aggressive prosecutors! Our public and crime victims need aggressive prosecutors and not progressive prosecutors. At this time I don’t know who the ADA was at the hearing, but what we can hear is very different than what DA Mulroy presented to the public. Shelby County has a Judge Anderson and DA Mulroy problem. This lack of honesty from our community’s top prosecutor is unacceptable, and I am madder than a mosquito at a wax museum about it. To Make Memphis Matter, we need a well-trained and aggressive team of attorneys fighting for our community’s safety in the DA’s office. Unfortunately, it appears we have Restorative Justice Schemers like Decarcerate Memphis and Just City running our criminal justice system. I plan to change that!" FOX13 reached out to Mulroy's office on Saturday following Sen. Taylor's social media posts and his office issued the following the statement: "At the Tyrese Earnest bail hearing, the prosecutor clearly argued for keeping the bond amount the same and against any ROR. Unfortunately, the court failed to record the majority of the state’s argument at the hearing’s very beginning. This happens on occasion because General Sessions is not a court of record, and court staff must turn the recorder on, which sometimes includes a lag. Nonetheless, the ADA, a veteran with over a decade of experience as a military prosecutor, noted the violent nature of the crime; the fact that someone could have died; the strength of the prosecution’s case; the serious prison time the defendant was facing; and thus the significant risk of flight, all of which counseled against ROR. Had the senator taken the time to consult with us before making his public statement, we could have explained this to him. People without courtroom experience can confuse a professional tone with a lack of passion. Lawyers know that, unlike on TV, a vociferous argument can sometimes be counterproductive. Bottom line: There is no stronger response to a bail decision than a writ to appeal it, which we began drafting immediately. Daniels ran for a season-high 127 yards and completed 24 of 36 passes for 227 yards and had two TD passes to Ertz and another to Olamide Zaccheaus to make the playoffs in his rookie year. In his latest comeback performance in a season full of them , the No. 2 overall pick in the draft in April shook off an interception and a 10-point halftime deficit and led the winning drive in overtime that was capped with the 2-yard pass to Ertz. The Commanders (11-5) could move up to the sixth seed in the NFC and set up a wild-card round game at Tampa Bay or the Los Angeles Rams if they win their regular-season finale at Dallas next weekend. Well, duh. Here's hoping everyone enjoyed their work, because the likes of it will probably never be seen again. Ohtani winning the National League MVP and Judge winning the American League MVP is about as surprising as the sun and moon changing places every 24 hours. Frankly, MLB Network's hour-long reveal special could have been condensed into two seconds. Though it was his first in the NL for the Los Angeles Dodgers, Ohtani now has three MVPs. That puts him in a club with only 11 other players, though he is the only one (h/t Sarah Langs of MLB.com) to win each of his three by unanimous votes. Judge, meanwhile, now has two MVPs and can count himself as one of seven players to win multiple MVPs as a New York Yankee. Though neither lived up to his billing in the playoffs, this moment is nothing if not an exclamation point for Ohtani and Judge. And in all likelihood, the 2024 season will go down as arguably the finest hour either slugger ever had. MLB Has Never Had an MVP Duo Like This One Remember when Ohtani and Judge went head-to-head in the 2022 AL MVP race? Though Judge won with 28 out of 30 first-place votes, even his AL-record-setting 62 home runs didn't paper over Ohtani's case completely. Rightfully so, as he was a top-five hitter and pitcher for the Los Angeles Angels that year. Compared to 2024, though, the '22 season looks like a warm-up act for Ohtani and Judge. Forced to take a break from pitching by way of a second major elbow operation , Ohtani set a career-high with a 190 OPS+ and, oh yeah, chartered MLB's 50-50 Club with 54 home runs and 59 stolen bases. For his part, Judge came two homers short of becoming the third hitter to post multiple 60-homer seasons. And this time, he posted career bests with a .322 average, a .458 OBP, a .701 slugging percentage and a 1.159 OPS. At his hottest, Judge had a 100-game span in which he had a 1.344 OPS and 45 home runs. The only other player to hit those marks within a single season: Barry Bonds in 2001. Don't say "Holy smokes" just yet, because it gets better. When you combine key stats for Ohtani and Judge, here's where they rank among MVP duos since the modern version of the award was born in 1931: This is not counting 1979, when Willie Stargell and Keith Hernandez shared the NL award and made it an MVP trio with AL winner Don Baylor. Otherwise, you just have to hand it to Stan Musial and Lou Boudreau for beating Ohtani and Judge with a combined 21.7 rWAR in 1948. As for what comes next for Ohtani and Judge, well, that's a nice parade you've got there. It would be a shame if someone rained on it. What's Next for Ohtani? As a general rule, doubting Shohei Ohtani is dangerous. It's because of him, after all, that we know it is possible for one person to be an elite hitter and an elite pitcher. And, of course, to top 50 homers and 50 steals in a season. Anyone who dared to proclaim as such before he came from Japan in 2017 probably would have tried as a heretic. It is nonetheless plausible that 2024 will be Ohtani's high point as a sheer offensive force, if for no other reason than he likely won't ever go 50-50 again. History says as much, as hitters are now just 1-for-95,387 in making such seasons happen. With his return to pitching due up in 2025, it's also worth remembering that Ohtani's two-way act functioned as a sort of tax on his offensive output between 2021 and 2023: Granted, the Dodgers will live with Ohtani being a less effective hitter if he still has the goods to dominate from the mound. And he will do so if his fastball still touches triple digits and his splitter and sweeper are filth-tastic. But does anyone want to bank on it? We know that Ohtani has had one Tommy John surgery . And while we knew frustratingly little at first, we learned via his surgeon in March that his second elbow surgery was part-Tommy John, part-internal brace procedure. Those who would be optimistic about Ohtani's pitching future after these surgeries don't have much to lean on. There aren't many success stories among pitchers who've had Tommy John multiple times. For pitchers who've had Tommy John and internal brace procedures, there's basically only Rich Hill and Drew Rasmussen to consider. Oh, and the Dodgers? They're not great at keeping pitchers healthy . Ohtani obviously won't be out of work if his return to pitching doesn't pan out. The surgery he had to repair a torn labrum in his left shoulder after the World Series doesn't set off loud alarms. It is neither his throwing shoulder nor his lead shoulder in the batter's box. Even still, you can probably rule out Ohtani ever stealing 50 bases again. He will enter his age-30 season in 2025, putting him in territory where 50-steal seasons have been exceedingly uncommon ( i.e., twice since 2001 ) in the 21st century. Otherwise, Bob Nightengale of USA Today reported in May that Ohtani would "likely be amenable" if the Dodgers asked him to give up pitching to be an outfielder. If that comes to pass, he'll have a whole new reason to spare his legs undue effort. What's Next for Judge? As for Judge, well, what is there to worry about? He just became only the second hitter since 1957 to top a 220 OPS+ in a season, and his Baseball Savant page looks like somebody spilled red paint all over it. Still, Judge is a 6'7", 282-pounder who will turn 33 on April 26, 2025, and who may or may not be needed back in center field. Where Judge plays going forward hinges on whether the Yankees re-sign Juan Soto. If they don't, right field will be open. If they do, it's notable that the Yankees preferred Judge in center even after they called up Jasson Domínguez late in 2024. If the Yankees continue to use Judge in center, they wouldn't be the first team to use a 33-year-old as a regular out there. But in recent times, precedents for that kind of behavior include guys like Kevin Kiermaier, Brett Gardner, Lorenzo Cain, Denard Span, Ángel Pagán and Coco Crisp. None of them was as big as Judge, whose size may be destined to become a problem no matter what. He's at an age where most hitters are either already burning out or are in danger of doing so. And for bigger hitters, the risk is greater. Upon tallying all the Runs Created ever produced, I found that hitters of 250 pounds or more compiled a larger percentage (87 percent) through the age of 32 than hitters under 250 pounds (84 percent). And this is just a general picture. Judge really is a special case, as he's one of only three hitters of at least 6'5" and 250 pounds to have had a notable career in MLB. The others are Adam Dunn and Frank Howard, and neither offers a compelling reason to believe Judge has a long runway of good seasons still ahead of him. Both were still pretty good at 33 and then a cliff came for each soon after. It's hard to imagine Judge's own cliff arriving so soon after he did [waves hands] that in 2024, but bear in mind that cliffs sneak up on hitters all the time. Heck, it was just two years ago that Paul Goldschmidt and Nolan Arenado finished first and third in the NL MVP voting. Now, the former is a middle-tier free agent and the latter is a salary-dump trade candidate . All this said, please don't mistake the takeaway here for a dire warning that Ohtani and Judge are doomed to fail in 2025 and forever afterward. This has been an attempt to ponder their mortality, not to dig their graves. Even more so, this is a plea not to take what Ohtani and Judge did in 2024 for granted. At the center of the controversy is a man named Knowledge Rutavi, who claims to be a representative of former employees but has been accused of being a criminal with connections to high-ranking politicians. Rutavi's background is questionable, with reports suggesting that he was dismissed from the Zimbabwe Republic Police (ZRP)due to corruption and misconduct. Despite this, he has managed to exert significant influence over the mine, allegedly using his connections claim, his closeness to second Vice president cde Kembo Mohadi , politibiro member Senator Cde Omega Hungwe , CIO high ranked official Tapomwa and the ZRP Deputy comissioner general Steve Mutamba to mention but just a few. It appears that these criminal individuals masquerading as former employees the likes of Knowledge Rutavi, Makotore and their colleagues committing fraud, and sabotaging investments and economic development. These criminals are reportedly enjoying the spoils of the mine's precious gold production, selling it on the black market without paying taxes or contributing to the government's national fiscas.1 Furthermore, the claims of unpaid salaries and terminal benefits dating back to 2018, have been long resolved by the Labour court . Criminals hiding under former employees made several attempts appealing agirnist Labour court running in favor of the company ,fraudulent attempt s of creating liability for the company to pay in usd not rtgs currenncy ot the time . Some appeals and dubious coperate rescue application were disregarded and dimissed by the Supreme Court of zimbabwe, some where removed off the role by the Comercial court of zimbabwe some time in August 2024 and some pending in the labor court. The company, Metallon Gold, committed to pay the owed salaries using bond notes ,pay ment was made in the employee legal practitioner account in 2019 but some employees rejected to collect demanding payment in US dollars instead. The mine was first established in 1896, during the colonial era, and was initially operated by the British South Africa Company. The mine changed hands several times, with various companies operating it until the 1960s. The mine was nationalized by the Zimbabwean government and operated by the Zimbabwe Mining Development Corporation (ZMDC). The mine was privatized and acquired by Metallon Gold, a company owned by Mzi Khumalo, a South African businessman. Mzi Khumalo, a South African businessman, acquired Metallon Gold in the 2000s and expanded the company's operations in Zimbabwe. Under Khumalo's leadership, Metallon Gold became one of the largest gold producers in Zimbabwe, with operations at Mazowe Jumbo Mine, among others. In 2023, Nambi Investments, a Zimbabwean company, acquired the Mazowe Jumbo Mine from Metallon Gold. The acquisition marked a new era for the mine, with Nambi Investments promising to revitalize operations and ensure the mine's sustainability.
